Brian Magovern…why do you defend this vindictive, conceited, manipulative man? You are better than that. Why are you taking the blame for his attempt at revenge on Joy? What a disgraceful display and an abuse of political power. Not one single elected official had the courage to stand up and do the right thing. Dave, please let us know when the permit is received. Many of us would like to be present for the planting. My heart and support goes out to Carmine and his family.
Thank you to all the residents who spoke at the meeting and especially to Katrina who called them all out. I was in tears listening to her at the end as I believe she may have been arrested. Was she? My God, such a simple thing to plant a tree in memory of a beloved woman. I’m sick, it seems in Belmar even if you play by all the rules, they change them at the last minute. I believe the Mayor and council are missing their SOULS.
She was not arrested.
This is who the Democrats of today are, arrogant, condescending and narcissistic. Vote Brennan OUT lets clean up our Mayor and council and vote these people out of office!

Councilman Walsifer needs to introduce an ordinance at the very next council meeting allowing for the shade tree commission to approve all memorial tree plantings! This was a true showing of the kind of person Matt is, and also the kind of people the council members are, for not even apologizing to Carmine that this happened! Seebeck should not have had to ask Brian to see this through, he should have offered!!! Matt continues to ruin Belmar!!!

Duties of the Shade Tree Commission:
a. Exercise full and exclusive control over the regulation, planting and care of shade and ornamental trees and shrubbery now located, or which may hereafter be planted, in any public highway, park or parkway, except such as are excluded pursuant to N.J.S.A. 40:64-10 in the Borough, including the planting, trimming, spraying, care and protection thereof;
Full and exclusive control? Except issuing permits? Except even knowing that permits are required.
A reporter needs to call each and every council member and ask how they feel about this issue and how it was all handled.

31-2.6 Permits Required.
a. Planting, Maintenance and Removal.
1. No person shall plant, prune, remove, or otherwise disturb any tree on any street or Borough-owned property without first filing an application and procuring a Permit from the Shade Tree Com-mission. The person receiving the Permit shall abide by the Arboricultural Specifications and Standards of Practice adopted by the Shade Tree Commission.
2. Application for Permits must be made at the Office of Code Enforcement not less than seventy-two (72) hours in advance of the time the work is to commence.
b. Standards of Issuance. The Shade Tree Commission or its designated agent shall issue a Permit provided for herein if, in the judgment of the Shade Tree Commission, the proposed work is desirable and the proposed method and workmanship thereof are of a satisfactory nature. Any Permit granted shall contain a definite date of expiration and the work shall be completed in the time allowed on the Permit and the manner as therein described. Any Permit shall be void if its terms are violated. If the Permit is denied, the applicant may appeal in writing to the Borough Council within seven (7) days of the denial.
A Permit shall finally be issued upon the payment of a fee by the applicant in an amount of ten ($10.00) dollars for each tree affected by the activity as specified in paragraph a.,1. hereof.
Notice of completion shall be given to the Borough Clerk in writing within five (5) working days to allow for inspection by the Shade Tree Commission or its designated agent.
c. Planting.
1. The application shall state the number of trees, location, grade, species, cultivar or variety of each tree, methods of planting; and such other information as the Shade Tree Commission finds necessary to a fair determination as to whether a Permit should be issued.
2. Whenever any tree shall be planted or set out in conflict with the provisions of this section, it shall be lawful for the Shade Tree Commission or its designated agent to remove or cause removal of the same, and the exact cost thereof shall be assessed to the owner as provided by law in the case of assessments, pursuant to N.J.S.A. 40:64-8 and 9.

WHEREAS, this holiday, called Arbor Day, was first observed with the planting of more than a
million trees in Nebraska; and
WHEREAS, Arbor Day is now observed throughout the nation and the world; and
WHEREAS, trees can reduce the erosion of our precious topsoil by wind and water, cut heating
and cooling costs, moderate the temperature, clean the air, produce life‐giving oxygen, and
provide habitat for wildlife; and
WHEREAS, trees are a renewable resource giving us paper, wood for our homes, fuel for our
fires and countless other wood products; and
WHEREAS, trees in our town increase property values, enhance the economic vitality of
business areas, and beautify our community; and
WHEREAS, trees, wherever they are planted, are a source of joy and spiritual renewal.
NOW, THEREFORE, the Mayor and Council of the Borough of Belmar do hereby proclaim April
28, 2017 as Arbor Day in the Borough of Belmar. And the Mayor and Council hereby urge all
citizens to celebrate Arbor Day and support efforts to protect our trees and woodlands and to
plant trees to gladden the heart and promote the well‐being of this and future generations.
Last line of that Proclamation should read – But don’t forget your PERMIT.
#1 Seashell, I have some background on this..In 2015 I brought attention to Council President, Brian Magovern a fraudulent check paid to Charlie Cavallo, D’Jais disc jockey for $500. approved by Tourism Commission for entertaining at a senior luncheon at which he never provided the services. Rather than taking it on my email and supporting documents. Not only did he not take care of it, my email and documents ended up in the hands of Belmar Police and criminal charges of “harassment” of Tourism Director were filed against me as Magovern watched me be bled of attorney fees for a year and the prosecutor drop the entire case just before trial. That is your Borough Council President. Joy went secretively around Belmar and raised thousands of dollars and surprised me with a check for my attorney fees. And that is Joy DeSanctis and so will ever be.
I am not an emotional person but this almost made me cry.

The Monarch Inn garden was planted by gnomes, permission granted by the gnome king by otherworldly decree. Magovern had nothing to do with it. Give the guy a break, he is too simple to have concocted that scheme, I mean, lovely tribute.

A knowledgeable friend suggested filing OPRA requests for any and all Code Enforcement permit applications pertaining to tree plantings in Belmar during the past five (5) years and, if filed and if each applicant paid $15 for said permits when were said applications approved by Council?

Why keep looking for some redeeming qualities about that guy? He is just tainted and corrupt like the rest of the denizens of the dais. The council members are just following their leader, a puppet-master of manipulation who lacks a moral compass. The Taylor Pavilion blocks Magovern’s view more than any tree would. He knows what is best for Belmar, whether it is legal or not. Don’t forget that he actually said that. Brian does not need anyone to make him look bad; he does a good job doing that all by himself.
I’m glad that Belmar doesn’t have a cemetery. Otherwise, the mayor would be out there stomping on graves.

I can’t believe the mayor did this. What does a tree have to do with anything? The Lady is dead. She cannot do him anymore harm. There was absolutely nothing to gain from doing this.

Brian had a chance to do the right thing and failed badly. All he had to do was go ahead and allow the tree to be planted on his own authority and that would have been the end of it. But he didn’t have what it takes to do the right thing.

Lastly, the Coast Star reporter must have made the report, but I think her employer[s] squelched it. That newspaper used to be very good but anymore, it stinks.
If the Mayor had any brains all he had to do was say sorry for the miscue I will straighten this out first thing tomorrow morning, and sorry for any misunderstanding. Unfortunately this Man has an ego bigger than Belmar.
Any Coast Star reporter who reports the nasty details about what goes on here suddenly disappears. Gee, I wonder why? Does the mayor threaten the paper, to withdraw whatever the borough pays them to have public notices printed? As soon as any reporter sniffs out the dirt, poof, gone.
Hat’s off to Mike Seebeck. Sincerely asked Brian to do the right thing and make this all right. We know Matt will never allow it but at least the attempt was made. To Brian…man up buddy. Last thought, Mike Seebeck would make a great Mayor.

Our always gracious mayor has shown his colors and they are an ugly hew. Such a shame that one who wishes to lead as a political stalwart has no grace about him but instead corrupts all those [read council] who are chained to him for reasons still unknown. Was Walsifer elected because he would speak out against such foolishness? Well good luck with that. And one suspects Brian would have gotten an earful at home in years past for condoning such vindictiveness.
