That is why Jim Bean had the “Bean Rule”. As long as the administration pays bills without the vote of Council, he would have no part in it. Thank God there are people like me who not only check these violations but in the case of Ferriera $1.1 million in wire transfers even show the council bill paid not even on the bill paid list.
    Is it legal. NO
Under NJ Law, you can recall all the council members for breach of fiduciary duty. Under our strong Mayor, weak Council Small Municipality Plan, This is one of only a few powers for the Legislative branch. That they should relinquish what little they have does not bode well for Belmar. At the last meeting, Councilman Brennan stated” Belmar Boro runs a tight ship and always has.” My research shows that it is so loose you can run an ocean liner through it.

Sounds unethical, to say the least. Fortunately someone is finding and critically reading these documents, but not the council members, who should be asking questions regarding whatever they vote on. Reminds me of Nancy Pelosi and her comment about the healthcare bill, something like: “Pass it and we will read and understand it later.” Jeesh, who voted for these people (dolts – that is not a vulgar word.) Instead of getting ones knickers in a twist about certain words, the critical readers of this blog should look at the local government and their shenanigans.

If Mr. Brennan said that, I have lost hope for him as an unadulterated thinker. I am sad, as I considered him to be intelligent.

Mayor Matt just proved that no council person is needed in the passing of ordinances and resolutions. He now has the authority to do it himself. Lets see if any council member stands up against this action or will they just kneel down at his feet like normal. If Mayor Doherty would just dissolve the council, declare himself ruler of Belmar, NOTHING would even change. This would be so much easier then trying to sneak things past the people.

This is criminal if not challenged.

If Belmar residents are not concerned that the mayor and entire council approved the payment of $925,000 without the proper resolution to do so, without asking one question, and without attending an Executive Session on the court settlement agreement then we are in bigger trouble than we realize. This is unlawful irresponsible behavior and I hold the mayor, and every Council member accountable. I also want to thank Ms. Desanctis for her constant vigilance regarding representing the residents in Belmar. She is the only one that has successfully accomplished anything good in this town if you ask me. She should run for office.

Belmar did not pay it’s bill for services rendered by Birdsall. We are DEFENDANTS in this matter we were SUED by Partner Engineering. If the mayor’s position was that Partner bought Birdsall’s assets for less than they were worth therefore Belmar shouldn’t pay the full amount due because Partner got a deal. Well then contact Partner or the bankruptcy trustee and try to settle for less, don’t wait to be sued you dope! Most companies that buy assets from other companies in bankruptcy typically purchase the assets for less than the valued amount. That does not give a permission slip for a debtor to also be guaranteed a “discount” for fees they owe the bankrupt company. And what about reimbursement from FEMA at this point? These fee were generated from services due to Sandy shouldn’t we receive some reimbursement or is that off the table too, something else the mayor forgot to do.

What I am trying to understand is why Birdsall Engineering Corp. offices on Industrial Way, Eatontown, NJ coincide with Partner Engineering’s Eatontown, NJ offices? Same address, different phones. Anyone figured that out?

I find it interesting the $925,000.00 elephant landed between PJ’s car wash (DPW) $252.52 and Photo Booth elegance (Belmar youth club)$595.00. Apparently nobody noticed the beast hiding in plain sight. I wonder if any of this amount is FEMA eligible? I wonder how we submitted engineering on our FEMA worksheets? I wonder why we didn’t pay Birdsall in the first place? I wonder if the administration questioned the invoices? (The Admin seemed satisfied with the $1,000,000 in engineering for Maser for the pavilions). I recall the Mayor and Council sticking with Birdsall, with high praise, when Birdsall’s troubles surfaced. I guess they didn’t recommend paying the firm. I wonder why no executive sessions occurred to inform the council members of this payment/settlement? Maybe ex sessions are an unnecessary formality in Belmar. I also wonder what $252 buys in DPW car washes at PJ’s? But I do agree with the $595 for the youth photo booth lest I be accused of being unreasonable. I wish with all my “I wonders” I could write a song like Sixto Rodriguez, “I wonder if this will add up” would be the title.

14 Teddy, Partner bought the assets of Birdsall Engineering in Bankruptcy Court this is nothing unusual done all the time. For example if you remember Sharper Image a company bought the name and has some stuff made under that name and you will see the items in some store or the internet.

I suspect that the $925K is the charge for the gold plated Pavilion design …. Remember, the regime said design was 90% complete when confidence was running high …. then, Belmartians woke up and the design went sour …. elections approached and the regime decided to kick the can to avoid a campaign issue.
Now we own plans for Pavilions that we can’t afford to build.

Personally I find the payment to Northeast Sweepers more interesting. I think we only have 1 sweeper and it’s only a year old? Also, why are some of the items billed to recycling and some billed to equipment repair? Does the sweeper only do laps around the DPW yard?

What we need to realize is that the council is not going start looking under the mayor’s rug or anyplace else to investigate for wrongdoings. They are fine going along with anything he wants to do. No matter what is posted on this blog and no matter what hard evidence the administrator posts to back it up, the mayor continues to do whatever he wants, how he wants to do it and with no consequences. For some reason, he is and has been able to get away with pretty much anything he decides to do. As a town, we need to start voting this council out one by one as their term expires, starting with Jen Nicolay and the upcoming election.
