Broadco Is Back

Broadco re-opens breach of

contract suit against Belmar,

subpoenas Jim Bean

Has reportedly already deposed Doherty,

Deicke, Magovern, Nicolay and Bill Young

I reported last May that contractor Broadco, which was hired days after Sandy to pump out flooded Silver Lake but was abruptly replaced by union-friendly J.H. Reid, did not provide discovery for the defense quickly enough and saw its breach of contract suit against Belmar dismissed. As I reported though, the action was taken “without prejudice” meaning that if and when they met the discovery requirements they could re-institute the complaint.

They did and they have.

I’m working on getting the most recent documents relating to the case, but this is what I had at the time of the dismissal last May:

Then there’s the Harmon Brothers lawsuit, the beach utility lawsuit, Darian Vitello’s lawsuits…….

Is it me or do we get sued a lot?

  7. #4-Belmar Independent-Great detective work! I’m assuming that you think the time you spent investigating the situation was well-spent. Important information (not willing to share with you) is relevant to this case. You don’t know all of the facts….yet you choose to make negative insinuations-you just want people involved in local government to be the bad guys. By the way, since I was councilwoman at the time of Sandy, I’m proud of our recovery, too……especially efforts by borough employees,police staff, volunteers, and yes, council members and Mayor Doherty. We were at the center every day for hours seeing to the details of recovery-assisting residents one-by-one as they made their way to our relief station in the gym. We tried to lift their spirits and offer emotional supposrt as well as come up with tangible solutions to the many probelms they were facing as they attempted to recover from the devastation. Residents had to recover emotionally, also. It wasn’t so long ago, so I remember well the great collaboration/coordination of efforts carried out by so many-the relief center, which was in operation for many weeks, proved effective in reaching out to residents who were in great need. Many obstacles were cast in front of us…..such as the destruction of the beachfront (back and running the following summer) homes restored (last two are about ready to be reopened) street and property floodings (town workers worked to get the waters to recede) people in a quandry about what was going on during the recovery (Mayor Doherty sent out daily reports to residents delivered by volunteers on foot who were dispatched throughout town) Our DPW worked tirelessly to bring our town back-your sarcastic remark (“I guess we’ll have to wait and see” remark) undermines the great efforts put forth by local residents (helping each other), volunteers from out of town (some coming from as far away as New York, Pennysylvania, Tennessee, and Connecticut). So, let’s get back to your orignial comment about me co-signing-are you happily musing that I’ll get in trouble? Or put through the wringer by attorneys? Is that why you brought my part in your expose up? Your mockery of the Mayor’s positive remark and your “let’s see” remark couldn’t be lower.

Those volunteers you mentioned from all those States took $9,000 in Shop Rite gift cards given to them from Belmar. I know because they don’t have Shop rites and they went around trying to trade them for cards they could use at home. I would never be happy that you or any other council member would get in trouble. It is just the constant pretense, lying and cover-up. 3 years now and I am sick of it. Stop using all the good people in town who did sacrifice and pitch in, all the time the political types used the tragedy for selfish purposes.
    Now that took 3 years of difficult research not a single minute on the borough website.

Instead of the ramp facing close to the handicapped spots they are opposite the spot. How about the Ash-Brit fiasco, or all the cop cars destroyed by according to Colleen driving them into salt water or R> Kirk under oath saying they were destroyed in the borough hall parking lot. Or skipping over the boathouse or Jersey BBQ on the T shirts as part of the volunteer help. Secret wire transfers, wedding rings, the list is endless. Tom-What you posted is so not true-both Matt and Brian were out in the town assisting residents at their homes-moving furniture/items from basements-cleaning up properties-how do I know this? while I spent most of my time in the relief center, I went with them a few times…while Jim Bean did his part, so did the other gentlemen on the council-in fact, Matt had major damage done to his own home-over $80,000 worth…..he never mentioned it-because he didn’t deal with his own situation because he was helping others…he did so after the fact-his wife Maggie told me of the damage to their home-also, the mayor never went hoime during the first two weeks of the devastation..he and borough staff slept at borough hall on cots.-his wife told him he had to come home because his children missed him….Brian, who lives along the lake, had a great deal of damage done to his home as well-but put that aside to serve the residents…both rolled up their sleeves and went to work-that’s what leaders do…..

  18. #9-Sure, lots went on during that very hectic time post Sandy-the boardwalk was restored for business as usual for the summer…that was of first and foremost importance…you don’t know what actually happened with the police cars-it was a combination of things that destroyed the cars-why is that so hard to accept-with all that was going on-the police cars were all over the place helping out-with the ring situation-that was rectified-although the young officer did lose it in the line of duty..I and other council members were constantly reaching out to JCP&L to restore power…I did so nearly every day during that time frame-why do you wish to minimize all that town leaders did during that period? I don’t understand your comment about the tee shirts…..no one-including you-has any real information about Asbritt..your suppositions about this are so off base…tying things together on a whim…we as government leaders did what we should have done-we looked after our residents..we put our families’ needs aside to assist our residents in their times of greatest need-to say that we did less is wrong and hurtful-I myself, with an ill mother-in-law and husband who needs me, put family aside-that’s what good leaders do…..that’s why I took the oath of office..to minimize my efforts and those of other council members is not only fair, it borders on being hateful…also, I’m happy that the homes are being restored with our back by summer program-one of those homes one is on my block-you have no idea about what the specs were, or have any actual information about why the homes were rebuilt as they were..or the needs of the individuals who’ll be returning to their homes soon.#14-to state that Jim was the only one being honest is out and out slander-why are you inferring that I was dishonest during that period? I miss seeing the children who reside there-great kids who are friendly and kind…a pleasure to have as neighbors-I’m happy they have a big, beautiful house to come home to after their long ordeal..with other family members….why would people begrudge them that? Why would anyone with a heart not be happy for that family? I don’t understand it.How does them coming home to a new, big, beautiful home impact your life?..-there you go, #21-like so many people who comment on this blog-assuming something that isn’t so…..assuming something negative about me..-we could care less if our property value increases-what a stupid assumption-do you think we’re all about money??

  27. Also-#21-you couldn’t be more wrong about the mayor-he’s supported my family when my mom passed away in a way that you, as a negative thinker, could never comprehend-and has been there for my family through good and bad times-giving emotional support….but what would you know about that?
    The mayor has also supported many families here in Belmar-a wrong assumption once again #22-I so resent your horrible criticism of Brian Magovern-you have no idea why he stayed-probably for good reason….he was like many homeowners who chose to stay in their homes during the hurricane-why would you choose to criticize someone who has done so much for the community and has lived through such recent sadness?     The councilman referred to usually goes along with everything the mayor wants, but he chose to disobey the evacuation order, for whatever reason, maybe thinking that the storm would not be so bad – who knows why, but as a councilman, I think he should have provided a commendable role model for others to follow in this instance. I am a person who sees a lot of monkey business going on in Belmar, duplicity and rule-bending. I do have a heart and feel bad that Magovern lost his wife and precious dog Cam.

Presently-or ever-or aniticipated in the future-hopefully, that clarifies my position and negates your point, #34…..I think these back and forths are very worthwhile-as words posted by commenters are often assumptions that can be proven incorrect-I think the back and forths are beneficial to all-and will keep on going whenever my name is posted-whenever someone wishes to position me in a negative way(which is often)-whenever inappropriate remarks appear with no real explanation, except to be negative-if you find that back and forths are tedious and go nowhere, why are you signing on??

YOU make no sense-I’m proud of how I respond, particularly with the information that I posted above about Sandy…..if you continue to call me out (although you state that it’s not worthwhile- I can’t figure that one out!)
