Mayor Matthew Doherty, an adamant supporter of the amended ordinance, was defiant, however.
“It was pretty much a meaningless election because our attorneys have already said that the existing ordinance is unconstitutional and unenforceable,” the mayor said. He said the borough would continue to press that argument in court…………….
………………“We have to follow the legal advice of our attorney’s,” Mayor Doherty said. Based on that advice, he said, the borough will proceed with an appeal of Superior Court Judge Katie A. Gummer’s decision on the ordinance, seeking a ruling on whether the original ordinance is, in fact, unconstitutional.
“We’re appealing her decision seeking a judge to make that determination,” Mayor Doherty said.
In response to Mayor Doherty’s plan to continue to fight the ordinance, Mr. Pringle said, “I think he’s delusional.”
“The appellate division already ruled on the issue whether the constitutionality of it should be addressed now and ruled that the referendum should go forward,” Mr. Pringle said.

The two incumbent council people up for reelection will suffer a great loss due to this delusional behavior. Mayor Doherty, the people spoke, now fight your battle on your own dime!

Must disagree on the definition. Matt is not insane. He’s inexperienced. Inexperience is worse than bad in my opinion. The same can be said for the befuddled council – although one of them does show a bit of experience on occasion.

Over 800 people just told you how they feel. A message to all council members, especially Brian and Janice, stop this stupidity or explain how any appeal makes sense. Any further fight should be by CANDIDATE Matt Doherty and not by the town.
How many times can they (mayor & council) beat a dead horse. Enough already. Makes you wonder who they are representing.

#4 has it right. Taxpayers in Belmar do not want to pay for the Mayors political collections of contributions from pay to play donors. Over 800 voters just told him that. Why continue this charade that ‘our ‘ lawyers say it is unconstitutional, Scarinci is his hired gun, we are just paying them big bucks so the mayor doesn’t have to. But if he can keep this ball in the air until Nov 8th he can keep on taking the contribs, keep on being a no show at meetings[ or show and recuse] and have that war chest full to spend. I suspect he does not really expect to win a freeholder seat but does expect to have a lot of money in his political kitty .

I think he knows he has no chance of being a freeholder,so he gets his sic ego of creating mayhem in Belmar. He is not a mayor , more of child doing things to create attention.
matt’s primary responsibility as mayor is to the town. He has made too many decisions that have not been in the best interest of the town and are self serving to his personal political career. It is long past due for this guy, who has lost the confidence of the Town of Belmar, to leave the office of mayor. Resign matt.
Considering the Mayor’s attorney has a strong opinion about winning an appeal, the attorney should take the case on a contingent bases…. He wins he gets paid, if not he gets nothing…. I bet his opinion on winning an appeal would be very different….
Using lawyers paid on a contingency basis should have been the Borough’s practice with all these lawsuits.
Soooo. What would prevent the M&C from drawing up a new Ordinance by changing just a few words from the one they just had voted down, and enacting that one? And then, does the whole cycle start over again, with a petition, lawsuit, referendum and such and so on and so on???? Sort of like the Pavilion voting fiasco. Any ideas out there?
Contingency basis rules. If you can’t handle the heat get out of the kitchen.
If a lawfirm has enough metal they will go the contingency route, if not that firm, whomever they may be will soak their clients. That firm has nothing to lose if they lose.

Take back Belmar! Give it back to the people! I don’t care if he goes back to Edison or spends 10 years in the clink! Doherty, Connelly, council, your time in this town is running out.
