A New Jersey municipality engages in spot zoning when it uses “the zoning power to benefit particular private interests rather than the collective interests of the community.”

Bottom line is that no, the developer could not have fallen back on CBD-1 and built the same building. Too many variances would have been needed. Too many requirements like design standards that would have needed to be met. Only thing that allowed the developer to build to this density is the spot-zoning #1 spoke of.

Great Project, great developer team looking forward to seeing the finish project. How lucky Belmar is to have residents in town who truly care about their community being the investors and developers on these types of projects, they are done with dignity and clearly from Mr. Taylors comments last night he is a good neighbor.
