Still No CAFRA Permit For Marina/Maclearie

Since the work on Chef’s marina building is under way, and the Maclearie Park re-do is set to commence soon, I assumed that the Borough had gotten the permitting all straightened out with DEP.  I decided to try again get a copy of it but was again told it doesn’t exist.

3-15-16 to 3-21-16

No permit?  How is that possible?

Thinking there might be something they are not telling me:opra

The response, edited down to just the texts of the emails:

3-15-16 908a

3-15-16 919n

3-15-16 920a

3-15-16 920a2

3-15-16 921n

3-29-16 308c

I understand the DEP did come to Belmar the other week.  I’ll let you know if I find out what happened.

I have copies of the Maser bills which paid for these plans and permits 3/15/16. So how is Ms. Claudio’s response via Maser even possible.
Jan. 15, 2016 Invoice #316029 for the work done by Maser’s Steven Sihota 63.75 hours- $8287.50 plus 2/10/16 Maser Invoice- Jacqueline McCort- $781.25 and the completed work $5131.25, Total $14,200. and yet no plans or amended permit?

Dave, by law they have 7 days to fulfill your request. If they can’t finalize your request, you can file a complaint with the state.. Belmar is hiding something for sure. I’m sure they let this construction go through because it was already finalized through communication but not on paper.

I’m not convinced they had even spoken permission but only written documents are OPRAable I guess.

Another example of the municipal clerk April Claudio working against the law and not providing documents per OPRA. The CAFRA application for a permit does not have go to the state before it goes to the public. In fact because it was prepared earlier the public missed the 30 day time frame to submit objections and questions. An opportunity lost due to April and Colleen’s unlawful practices. What are they hiding?

Apparently April and/or Colleen had a permit on March 15th as is in the corrected email from April. Think the appropriate response should have been sent to you on March 15th that the record you requested was still being drafted and will be available to you when completed. Not that there is no record. Transparency?? Sounds as if it’s in Colleen’s hands now.

I would file a suite Dave. You have a right to these documents. You can’t let them walk all over you like this.

I’m not convinced that the documents do actually exist. They might be working without a permit. (I don’t know which is worse.)

Dave, probably a good time for a review. (I know you are busy, but you did start this).
Your Blog Posted- Maritime Disaster after the Marina Bldg. was demolished and no changes to CAFRA plan or permits. November 7, 2015.
Thus initiating the beginning of many OPRA requests to Belmar.
November 11, 2015, 4:57 p.m. Comment #37. Claire Deicke “all has been dealt with-borough and engineer reps have resolved concerns posted.” Former Council President Deicke may be referring to an email that Nick DeCotiis sent to D.E.P. on November 9, 2015 “I apologize for the delay in addressing CAFRA violations (2014)…we finally have ironed out the current and future work that would be covered under the revised permit and have prepared (past tense) plans for submission. Who should we be sending everything to…”

OR Maybe Claire is referencing Colleen Connolly’s Email to principals at D.E.P. 24 hours after her post stating:” Nick assured me the application/plans would most likely be submitted by early December.”

OK so, your blog and a bunch of obstructionists who live near Maclearie Park (not to mention the complete demolition of the Marina Bldg. site) got the ball rolling on permits. What Belmar, is telling you Dave, is that even though Maser went to work on them later in December 2015, finished the plans and applications in Jan. 2016. Colleen Connolly did not send the plans to Trenton. She did this just to make Claire a liar?

Just noticed the date MARCH 29 when Colleen is now trying to cover her ass and say the document is being worked on. (it was already done but not provided.)

Dave you requested all communication on MARCH 21 anything after that date is all created for the record to keep April from being charged again for not acting properly in her position as Municipal Clerk. Only the March 15 trail of emails count.

PLUS the meeting with the DEP was held MARCH 24 when allegedly the document was complete and given to the state. So Colleen’s ass saving statement she emailed on MARCH 29 is really full of back pedaling lies.
