Amended Report Raises Serious Questions

Just to bring you up to speed, you remember last month we pointed out a $610 donation that the Monmouth County Democratic Women’s Caucus reported making to the 2015 Nicolay for Council campaign.  Not only was the donation unmentioned in Nicolay’s reports, a violation of state election law, the donation itself was also in violation of Belmar’s campaign finance laws at the time, which forbade candidates from taking committee money.

The following week the Coast Star ran a story about it.  Both Ms. Nicolay and Rentha Onitiri of the Women’s Caucus claimed that the check was returned although the two gave two different reasons for the check being returned.  Of course state campaign finance law states that any checks received must be put into the campaign depository…and reported…and then if the check can’t be accepted a refund check is to be written from the campaign depository…and reported.  You are never supposed to just hand a check back to the donor.

In any case, Ms. Onitiri produced the “returned’ check for the Coast Star reporter. She said it had been lost and later found “buried in paperwork” and the fact that the check number on the check she produced was 1053, instead of 1056 which is the number on their report, was a mistake.  She also said she would be filing an amended report showing the check as being number 1053 and also showing the check as having been returned.  Below is the story, republished with the permission of the Star:

While we were waiting for the amended report, the $610 was found on a report from the Belmar Democratic Committee, contradicting the claims by both ladies that the $610 was returned to the Women’s Caucus.

Clicking on the image above will bring you to the post where I reported on this.  Notice despite several commenters asking for Democratic Committee Chair Claire Deicke to clarify whether the money was returned to the Caucus or not, no answer was forthcoming.

The Monmouth County Democratic Women’s Caucus filed their amended report this week, as promised, and the state put it up on the ELEC website yesterday.  They are still showing the check as being number 1056, not 1053 as they had claimed earlier.  And they are not showing the check as having been returned to them, as Nicolay and Onitiri had claimed.  Instead they are showing it as having gone to the Belmar Democratic Committee BUT FOR JENNIFER NICOLAY AND FOR THE NOV 3, 2015 ELECTION!!

First of all, what happened to the check being returned? And what happened to the check actually being number 1053?  And they can’t earmark a contribution to a committee as being for a certain candidate and a certain election.  They are trying to fudge it and have it both ways but it is not going to work.  The donation was either to the Belmar Democratic Committee or it was to Jennifer Nicolay’s campaign.  If it was to the Democratic Committee then all that stuff about returned checks was a lie.  On top of that they have to be able to show that it was to the Committee from the start and not to Nicolay.  This is serious stuff.  You can’t simply sign donation checks over between committees and later change the report to the other committee.

If it was to Nicolay…and they are still saying that it was for her election…then we’re back to Nicolay voting to repeal an ordinance that she was in violation of at the time and still is.

They need to stop trying to paper over this mess and come clean about what actually happened.  And they need to file a new amended report, this time one that is truthful and accurate.  The more they try to hide whatever happened the more jammed up they are going to get.

Will keep checking the ELEC website and will report any developments.

    I am getting tired of this. I tell you what if there are no ADA bathrooms at Maclearie Park by Memorial day (not a portable trailer either) then I can’t be held responsible for where I pee. I saw a boy the other day peeing on a tree boy that looks good from Rte 35. When asked by a judge why I will have to say there is no place to pee for a disabled person in all of the park and I think by law there has to be. I wonder what type of discovery that will open up. You just don’t see Nicolay broke the law and tried to cover it up, you could work for Billary.

Also, the return of that donation would have shown up on the Belmar Democrats report, it has not. Claire, this is serious because you, or Nicolay, or the Women’s Caucus can’t get your story straight. It’s serious because based on Belmar ordinance, Nicolay may have taken pass through contributions and thus was in conflict and should not have been allowed to vote on a plethora of items on agenda.

    Thing is the state doesn’t require reports as some kind of academic exercise. The reports are required because the public has a right to see this information and scrutinize it. And the reports have to be accurate. There’s obviously some sort of problem with this report and if the report is not accurate then the public has been denied its right to know.
