Again I smell another RAT !!!!
I’m very happy to see the paragraph killing the OSHA requirement gone. I despise OSHA. But as Vito says, it might very well be some sort of trick. Let’s await developments.
Don’t applaud yet, it’s not a done deal. The joker is still in the deck, and he is tricky.
I will be at Belmar fitness site,Thursday night 6pm to hear about the 2 story addition and the proposed resturant and zoning changes that have the backing of the mayor, for ocean ave belmar fitness site, along with my neighbors, it’s a shame Matt can’t leave well enough alone. Congestion is not a benifit to the homeowners in this densely populated area.
Bill, why at the site? Wouldn’t that discussion be for a planning board meeting?
My guess is that the guy wants to have an informal discussion about it with the people in the area first.

Let us face the facts …. any establishment that has a liquor license will create quality of life issues for nearby residential areas …. Even La Dolce Vita …. whose owner prides himself a “good neighbor” …. had the outside music cranked-up on Sept 27th to an annoying level …. 3 blocks inland …. into the night.
No matter what the owner or the elected officials promise you …. better to nip it in the bud.

I would like to thank you for providing such a great service to your community. I never had commented before, but something just doesn’t seem right. I went back and reviewed several of your meeting videos only to see that there was “Never” any compromising on behalf of the committee in regards to the language in the disputed ordinance. All committee people with the exception on Mr. Bean held their ground and supported the responsible bidder position. I am aware of an election on the horizon, and would hope that this repeal is not a political play and that it is being done in the interest of Belmar.
My main concern is that the entire ordinance is being repealed. It appears, after listening to the public comments on October 1, 2014, the public’s objection was directly related to specific “responsible Bidder” requirements spelled out in paragraph 1.a. (Requirement that the bidder participates in the U.S. Department of Labor Bureau’s Apprenticeship and Training Program). This specific wording/requirement eliminates a large pool of quality bidders. The ordinance also suggest, in Section 2, that if any section of this ordinance is deemed invalid, the section deemed invalid will only apply to that section and the rest of the ordinance will remain in effect.
I would be very hesitant in repealing this ordinance in its entirety and not having a “Receipt of Bids” ordinance in place. I feel it would be prudent to remove only this specific section/paragraph 1.a. of the ordinance and deem it invalid until a new, reviewed and revised resolution can be drafted.
I would also feel much more comfortable knowing, if the committee plans on proposing a new ordinance or draft ordinance. If so, it would also be appropriate for the public to have ample time and opportunity to review and digest prior to any meeting or vote.
I find it difficult to understand why this simple request to remove such a small part of an ordinance has come with such opposition. The unwillingness to change or listen to the voice of the community could be perceived as having an ulterior motive. I would hope that the mayor and committee will listen to the voice of the community and do what best for the town of Belmar.
Please note that when “PJ” says “committee” he/she is referring to the Council, not the committee of petitioners.

I SMELL A BIG RAT…. SOME SORT OF EXCHANGE/DEALFOR REPEALING THE ORDINANCE…
BELMAR FITNESS SALE=MORE BOOZE FLOWING.
Use of language to deceive? No “beer garden” the mayor claimed, but a restaurant that serves alcohol? Tricky Joker.
The simple answer to PJ’s question is that the Mayor & Council are rescinding the ordinance in its entirety now because of the suit we filed two weeks ago, in which we alleged they enacted it illegally. By quickly rescinding the ordinance (after spending weeks trying to defend it), they are hoping to avoid yet another court ruling against them. I have no doubt they will attempt to re-introduce it in some form if Doherty & Brennan win. In the meantime, don’t worry about losing the other language in the ordinance. That was all window dressing to take attention off the apprenticeship provision. Existing state law provides municipalities with ample protections against unqualified bidders in the bidding process.
What about the conflict of interest charge is that now a dead issue or does that case still go on ?

Any meeting at Belmar Fitness is a distractor. Go to the the Mayor and Council meeting at Borough Hall at 6:00 P.M. Thursday and express your concerns. Demand answers.
Belmar fitness meeting tonight was nicely attended I would say about a dozen people were there, We got to hear from the new property owner of (Belmar Fitness) Robert Eliseo, that He is not building a restaurant or bar. He is looking to do the typical condos upstairs above a commercial first floor, I wish Robert well, and I take him at his word that We residents will all be happy with his tenants. Anyone looking to open a gym or one of those fancy pilates studios, or an art gallery 🙂 its a great location, go meet Robert bring him your ideas.

Real Estate is not moving. Why start that now? Unless he is paying cash. Banks are very reluctant to loan $$$ for condos,townhomes etc. None of the five families are investing in real estate now.
Commercial first floor has alot of sq. ft.
I am still puzzled about the supposed Wall Street Journal “misquote” of Doherty’s statement that a beer garden is coming to Ocean Avenue. Where?
Seems he gets misquoted a lot.
Take a look at the size of the beer hall deck and pizzeria planned on the 3rd floor of the brewery, party usa baby. That outdoor deck looks good, could give Bar Anticipation a run for Tuesday night keg night!
Glad I did not buy an apartment or rent one across the street from this location. The loud live music from 10th Avenue Burrito carries pretty far when the wind blows.
